SplatView End-User License Agreement
Version 1.3 - October 15, 2026

1. Agreement and publisher
This End-User License Agreement ("Agreement") is between you and OpsiClear LLC,
a United States limited liability company ("OpsiClear", "we", "us"). It covers
the official SplatView application, Explorer integration, save helper, related
documentation and updates supplied under this Agreement ("Software").
Contact: support@opsiclear.com.

By accepting this Agreement, or installing or using the Software after an
opportunity to review it, you agree to these terms. Otherwise do not install
or use it. If acting for an organization, you must have authority to bind it;
"you" then includes that organization.

2. Free license and permitted use
Subject to this Agreement, we grant you a non-exclusive, worldwide license to
install and use official Software binaries on devices you own or control for
personal, educational and commercial purposes, without a license fee for the
functionality included in this release. You may make reasonable backup copies
and deploy the Software internally to your organization's authorized users,
provided they comply with this Agreement. You may share links to our official
downloads. Other distribution requires our written permission or authorization
through an official distribution channel.

The Software is licensed, not sold. No source-code access or ownership rights
are granted. OpsiClear and its licensors retain rights not expressly granted.
No rights to use our names, logos or branding to imply endorsement are granted.

This release has no ads, paid features or subscriptions. Future releases
or optional services may have separate terms and prices. Charges require your
affirmative agreement. No later purchase is required to use this free release;
future releases need not be free.

3. Restrictions
Except where applicable law, Microsoft Store usage rights or a third-party
license gives you the right, you may not:
- Modify, translate, create derivative works of, reverse engineer, decompile
or disassemble the proprietary parts of the Software.
- Resell, rent, sublicense, publicly redistribute or offer the Software as a
separately hosted service without our written permission.
- Remove or alter copyright, attribution, license or proprietary notices.
- Bypass technical protections or misrepresent the Software's source.
- Use the Software unlawfully or infringe another person's rights.

These restrictions do not apply to your content or prevent internal business
use under section 2, mandatory interoperability or other legal rights.

4. Your files, outputs and responsibilities
You retain your rights in your scene files, images, measurements, exports and
other content. You may use outputs commercially, subject to any rights in the
input content. You are responsible for having the rights needed to process
your content and for checking your work before relying on, sharing or
overwriting it.

The Software performs local scene processing. Keep independent backup copies
of important files. Experimental functionality may be incomplete or produce
inaccurate results. Verify measurements, edited scenes, thumbnails and exports
independently. The Software is not designed as the sole basis for
decisions or operations where an error could cause injury or significant harm.

Programs you connect through optional agent access act with your permissions;
you are responsible for them, including what they send to their providers.

5. Third-party components and distribution platforms
Third-party components, adapted code and assets retain their separate licenses.
See THIRD-PARTY-NOTICES.txt and the accompanying licenses directory. Those
licenses control the respective materials and prevail over this Agreement
where necessary to preserve their permissions. Nothing here restricts rights
granted under those licenses, requires surrender of them, or changes rights
previously granted for copies distributed under a different license.

For Microsoft Store acquisitions, this Agreement is between you and OpsiClear,
not Microsoft. Your Store transactions and Microsoft services remain governed
by their applicable terms. Your rights to download, stream, install and use
the Software are at least those provided by the Microsoft Usage Rules
applicable to it; those rights prevail over any conflicting restriction here.
OpsiClear is responsible for the Software and any support it provides.

6. Privacy and optional reporting
Our separate privacy information in PRIVACY.txt describes data practices.
Scene files and outputs are not uploaded by the Software. Usage reporting and
error reporting are separate, optional settings, off by default. Declining or
disabling either does not restrict the current free functionality. Accepting
this Agreement does not opt you into reporting, advertising or marketing.
Bug reports and support requests follow the applicable privacy information.
Submit only material you have permission to share.

7. Updates, support and changes
Microsoft Store copies may check for and download updates through Windows
Store services, subject to Windows and Store settings. Updates do not themselves
enable optional reporting.
Subject to law and Store obligations, we may change or discontinue future
releases, support or optional services. We do not promise updates, response
times, compatibility with every system or continued support.

Materially revised terms will be presented before applying to a new version,
with acceptance obtained where required. They do not change earlier rights
retroactively. This Agreement also covers updates unless they specify otherwise.

8. Feedback
If you voluntarily provide non-confidential suggestions or improvement ideas,
you grant OpsiClear a worldwide, perpetual, irrevocable, non-exclusive,
royalty-free license to use, reproduce, adapt and incorporate that feedback
without an obligation to pay or attribute you. This does not transfer ownership
of your files or license content you merely open or create in the Software.
Personal information remains subject to the applicable privacy information.

9. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND ANY SUPPORT
ARE PROVIDED "AS IS", "WITH ALL FAULTS" AND "AS AVAILABLE". OPSICLEAR AND ITS
LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY,
INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND
NON-INFRINGEMENT. WE DO NOT WARRANT ACCURACY, UNINTERRUPTED OR ERROR-FREE
OPERATION, SECURITY, COMPATIBILITY OR THAT FILES OR DATA WILL BE PRESERVED.
THIS DISCLAIMER DOES NOT OVERRIDE A WARRANTY THAT APPLICABLE LAW REQUIRES US
TO HONOR.

10. Exclusion and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPSICLEAR AND ITS LICENSORS HAVE NO
LIABILITY FOR CLAIMS, LOSSES, COSTS OR DAMAGES ARISING FROM THE SOFTWARE OR THIS
AGREEMENT, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES AND LOSS OF PROFITS, BUSINESS, DATA OR USE, EVEN IF ADVISED OF THE RISK.
IF FULL EXCLUSION IS UNENFORCEABLE BUT A MONETARY LIMIT IS PERMITTED, THEIR
TOTAL AGGREGATE LIABILITY WILL NOT EXCEED US$100 (OR ITS LOCAL EQUIVALENT).
THESE PROVISIONS APPLY TO CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE) AND
OTHER LEGAL THEORIES, SUBJECT TO THE EXCEPTIONS BELOW.

NOTHING IN THIS AGREEMENT EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL
MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE,
OR ANY OTHER LIABILITY OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
IF YOUR JURISDICTION DOES NOT ALLOW A PARTICULAR DISCLAIMER OR LIMITATION,
IT APPLIES ONLY TO THE EXTENT ALLOWED. YOUR MANDATORY CONSUMER RIGHTS REMAIN.

11. Business-user indemnity
For business use, to the extent permitted by law, your business will defend
and indemnify OpsiClear and its officers and employees against third-party
claims and reasonable costs, including attorneys' fees, arising from its
unlawful use, unauthorized distribution or infringement by content it supplies.
This excludes claims caused by OpsiClear's breach, negligence or misconduct.
OpsiClear must promptly notify the business, reasonably cooperate and allow a
reasonable defense. Settlements imposing an admission or obligation on
OpsiClear require its consent, not unreasonably withheld.

12. Term and termination
Your license continues until terminated. You may terminate by uninstalling
and deleting your copies. We may terminate for material breach, after notice
and 30 days to cure a curable breach. Where lawful, termination may be immediate
for unlawful use, deliberate infringement or an incurable material breach.
Then stop using and delete the proprietary Software, except legally required
archival copies. Your content and separate third-party rights are unaffected.
Ownership, feedback, disclaimers, liability limits, applicable indemnity and
general terms survive as needed to give them effect.

13. General terms
Comply with export-control and sanctions laws applicable to your use.
Mandatory law and non-waivable consumer protections take priority over this
Agreement. An unenforceable provision will be limited as legally permitted,
and the remaining provisions will continue in effect. A delay in enforcement
does not waive a right.

Transfers require our consent unless allowed by law or Store usage rights.
We may assign this Agreement to a successor to the relevant business, subject
to law and without reducing your mandatory rights.

This is the complete agreement on use of the proprietary Software, subject to
the separate terms described above. Changes require a valid revised agreement
or a written agreement with OpsiClear.
